Conveyancing is the term used to describe the legal process of
buying or selling land or buildings.
In Scotland the first stage of a conveyancing transaction (whether
a purchase or a sale) is agreeing the terms and conditions of
the deal and embodying them in a formal contract called Missives.
This is a very important stage in the conveyancing process in
Scotland and may require a lot of communication between solicitor
and client. It is important that you are aware that the contract
is made in writing and usually by solicitors acting as agents
for the client and without the client signing any formal document
at this stage.

hours, and help you decide on the price to offer. Thereafter,
we will submit a formal written offer to purchase on your behalf
leading to the adjustment and concluding of Missives as referred
As your solicitor we will examine the seller's title deeds and
require him to produce clear Searches to ensure that the title
is a valid one and that there is nothing to prevent the seller
from granting a good title to you. We will also inform you of
any unusual burdens or conditions in the title deeds that may
regulate or even limit the extent to which you can use the property.
If you require a mortgage we can assist you to find the best mortgage
deal for you and will prepare the mortgage deeds to provide the
lender with their security.
The sale process involves the repayment of any outstanding mortgage
including the preparation of a formal Discharge of the security,
dealing with any enquiries from the purchaser's solicitors regarding
the conditions of the title deeds, instructing all the searches
and generally doing all that is necessary to provide a good and
valid title to the purchaser.
